AMERICAN TEXTILE COMPANY PRIVACY NOTICE

American Textile Company and its affiliates (“ATC”, “our,” “us,” or “we”) respects and is committed to protecting your privacy. This Privacy Notice explains how we collect, use, and protect personal information, when and to whom we disclose such information, and the choices available to you concerning the use and disclosure of that information. 

 

Collection of Personal Information 

ATC may collect the following categories of Personal Information: 

  • contact information (e.g., name, address, phone number, email address) for you or others (e.g. owners or principals of your business); 
  • biographical and demographic information (e.g., date of birth, gender, marital status, job title/position); 
  • identity information (e.g. Social Security Number, driver’s license, passport, or other government ID number); 
  • financial account information (e.g. payment information, including name, billing address and payment card details; financial statements); 
  • location and geolocation data; 
  • information about your use of, or interaction with, our or others’ websites, applications or advertisements; and 
  • other personal information, such as calendar events, necessary to provide products or services to you. 

 

We may collect Personal Information about you from: 

  • you or your agent; 
  • your transactions or interactions with ATC (including through ATC’s Shopify store), our affiliates, or others;
  • third party companies who support our site and services, such as Shopify;
  • third party advertising vendors, data analytic providers, internet service providers, and social networks; and 
  • consumer reporting agencies and/or governmental entities, either directly from these entities or through others. 

 

Collection of Sensitive Personal Data

Some of the data we collect, such as precise geolocation of your mobile device and certain payment card information, maybe be considered sensitive personal data depending on the applicable laws of the jurisdiction in which you reside or are located.

 

Collection of Browsing Information 

ATC automatically collects the following types of Browsing Information when you access our website found at shop.americantextile.com and allereaseplatinum.com, online service, or application from your Internet browser, computer, and/or device: 

  • Internet Protocol (IP) address and operating system; 
  • browser version, language, and type; 
  • domain name system requests; and 
  • browsing history on our website, such as date and time of your visit to the website, and visits to the pages within our website.

Like most websites, our servers automatically log each visitor to our website and may collect the Browsing Information described above. We use Browsing Information for system administration, troubleshooting, fraud investigation, and to improve our website. Browsing Information generally does not reveal anything personal about you, though if you have created a user account with us and are logged into that account, then we may be able to link certain browsing activity to your user account. 

 

Other Online Specifics 

Cookies.  Like many websites, we use Cookies on our Site. For specific information about the Cookies that we use related to powering our store with Shopify, see https://www.shopify.com/legal/cookies. We use Cookies to power and improve our Site and our Services (including to remember your actions and preferences), to run analytics and better understand user interaction with the Services (in our legitimate interests to administer, improve and optimize the Services). We may also permit third parties and services providers to use Cookies on our Site to better tailor the services, products and advertising on our Site and other websites. 

Most browsers automatically accept Cookies by default, but you can choose to set your browser to remove or reject Cookies through your browser controls. Please keep in mind that removing or blocking Cookies can negatively impact your user experience and may cause some of the Services, including certain features and general functionality, to work incorrectly or no longer be available. Web Beacons. We may use web beacons to determine when and how many times a page has been viewed. This information is used to improve our website.

Links to Other Sites. Our website may contain links to unaffiliated third-party websites. We are not responsible for the privacy practices or content of those websites. We recommend that you read the privacy policy of every website you visit. 

Third Party Advertisers. We work with third-party vendors to advertise our products online. These vendors, such as Google and Meta, show our ads on various websites across the internet and use technologies such as cookies, device identifiers, and/or remarketing pixels, to show ads based on certain criteria, including your prior use of our websites or app(s). We will not share information regarding your use of our website or apps with those third-party advertisers if you opt out of such cookie sharing. If you want to manage our use of cookies, use the cookie banner found on our website. To opt out of Google’s use of cookies or device identifiers more broadly, you can adjust your Google Ads Settings. Alternatively, you can opt out of a third-party vendor’s use of cookies by visiting the Network Advertising Initiative opt-out page found at https://optout.networkadvertising.org/?c=1 or control the use of device identifiers by using your device’s settings.

 

Use of Personal Information 

ATC may use Personal Information for any purposes not inconsistent with ATC’s statements under this Privacy Notice, or otherwise made by us in writing at the point of collection, and not prohibited by applicable law, including, without limitation, the following:

  • To provide or advertise products and services to you or your company or in connection with a transaction involving you. 
  • To advertise to you.
  • To provide support for, personalize, develop or improve our website, products and services. 
  • To communicate with you about our, our affiliates’, and others’ products and services, jointly or independently. 
  • To create deidentified, aggregate, anonymized or pseudonymous data.
  • For internal business purposes.

 

When Information Is Disclosed 

We may disclose your Personal Information and Browsing Information in the following circumstances:

The law does not require your prior authorization and does not allow you to restrict the disclosures described above. Additionally, we may disclose your information to third parties for whom you have given us authorization or consent to make such disclosure. We do not otherwise share your Personal Information or Browsing Information with nonaffiliated third parties, except as required or permitted by law. We may share your Personal Information with affiliates to directly market to you. 

We reserve the right to transfer your Personal Information, Browsing Information, and any other information, in connection with the sale or other disposition of all or part of our business and/or assets, or in the event of bankruptcy, reorganization, insolvency, receivership, or an assignment for the benefit of creditors. By submitting Personal Information and/or Browsing Information to us, you expressly agree and consent to the use and/or transfer of the foregoing information in connection with any of the above-described proceedings. 

We have, in the past 12 months, disclosed the following categories of Personal Information about users for the purposes set out above in “Collection of Personal Information,” “Collection of Browsing Information,” “Use of Personal Information,” and “When Information is Disclosed”.

  • Identifiers such as basic contact details and certain order and account information;
  • Commercial information such as order information, shopping information and customer support information;

We maintain physical, electronic, and procedural safeguards to protect your Personal Information. 

 

User Generated Content

Our website may enable you to post product reviews and other user-generated content. If you choose to submit user-generated content to any public areas of the Services, this content will be public and accessible by anyone.

We do not control who has access to the information that you choose to make available to others, and cannot ensure that parties who have access to such information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information that you make publicly available, or for the accuracy, use or misuse of any information that you disclose or receive from third parties.

 

Retention Periods

Due to the breadth and variety of data collected by ATC, it is not possible for us to provide you with a comprehensive list of timeframes during which we retain each category of Personal Information. ATC retains categories of information as reasonably necessary to satisfy the purpose for which we collect the information. This time period varies depending on the purpose for which we collected the information, the nature and frequency of our interactions and relationship with you, whether we have a legal basis to continue retaining the information, industry practices, the value and sensitivity of the information, and state and federal recordkeeping requirements. 

 

Your Rights and Choices With Your Information 

Depending on where you live, you may have some or all of the rights listed below in relation to your Personal Information. These rights are not absolute and may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

-Right to Access/Know. You may have a right to request access to Personal Information that ATC maintains about you, including details relating to the ways in which we use and share your information.

-Right to Delete. You may have a right to request that we delete Personal Information that ATC maintains about you.

-Right to Correct. You may have a right to request that we correct inaccurate Personal Information ATC maintains about you.

-Right of Portability. You may have a right to receive a copy of the Personal Information ATC holds about you and to request that ATC transfer it to a third party, in certain circumstances and with certain exceptions.

If you do not want us to share your information among our affiliates to directly market to you, you may send an “opt out” request as directed at the end of this Privacy Notice. We do not share your Personal Information with nonaffiliates for their use to direct market to you without your consent. Whether you submit Personal Information or Browsing Information to us is entirely up to you. If you decide not to submit Personal Information or Browsing Information, we may not be able to provide certain services or products to you.

If you are not satisfied with ATC’s response to your complaint, depending on where you live you may have the right to appeal our decision by contacting ATC using the contact details set out below, or lodge your complaint with your local data protection authority.

Information From Children 

Our website is not intended or designed to attract persons under the age of eighteen (18). We do not collect Personal Information from any person that we know to be under the age of thirteen (13) without permission from a parent or guardian. 

 

International Users 

Our headquarters is located within the United States. If you reside outside the United States and choose to provide Personal Information or Browsing Information to us, please note that we may transfer that information outside of your country of residence to countries including but not limited to the United States and the Philippines. By providing us with your Personal Information and/or Browsing Information, you consent to our collection, transfer, and use of such information in accordance with this Privacy Notice.

By submitting Personal Information and/or Browsing Information to us, you consent to the collection and use of the information in accordance with this Privacy Notice. We may change this Privacy Notice at any time. The Privacy Notice’s effective date will show the last date changes were made. We may collect and use the categories of California Personal Data described in the “California Personal Data We Collect” subsection above for one or more of the business and commercial purposes described in the “How We Use Personal Data” section above. Notwithstanding the foregoing, we do not use, disclose, or otherwise process California Personal Data defined as “sensitive personal information” under the CCPA for purposes other than those specified in California Code of Regulations § 7027(m).

We do not sell California Personal Data collected through the Services or share California Personal Data collected through the Services for cross-context behavioral advertising purposes. We have not sold California Personal Data collected through the Services or shared California Personal Data collected through the Services for cross-context behavioral advertising purposes in the preceding 12 months. We do not have actual knowledge that we sell California Personal Data of consumers under 16 years of age or share the California Personal Data of consumers under the age of 16 for cross-context behavioral advertising purposes.
